These Terms & Conditions, together with your signed written enrollment form, electronic online enrollment record, or recorded telephone voice enrollment is an agreement (“Agreement”) for purchase of carbon offsets between you (“Customer”) and CleanChoice Energy Solutions, LLC (“CleanChoice Energy,” “We,” or “Us”).

Carbon Offsets: A carbon offset is a reduction in emissions of carbon dioxide or greenhouse gases made in order to compensate for or to offset an emission made elsewhere. For each month of your service, we will purchase and retire carbon offsets based on the carbon dioxide equivalent for average household natural gas usage in the United States. Your actual monthly usage may be more or less than the average and therefore we cannot guarantee that your household carbon footprint will be fully matched by carbon offsets. We will purchase and retire carbon offsets annually and We may take up to three (3) months following the close of a calendar year to purchase and retire carbon offsets on your behalf. After We purchase carbon offsets on your behalf, We have no further obligation to you.

Your purchase of carbon offsets is not an electricity, natural gas, propane, oil or other fuel purchase and does not impact the price you pay or the service you might receive for any of these commodities. You continue to pay your regular utility propane, oil or other fuel bill, plus an additional monthly payment to CleanChoice Energy for your carbon offsets.

Payment and Billing: Your Monthly Payment for carbon offsets is $9.00 per month. We will process your Monthly Payment through the credit card or Automatic Clearing House (ACH) account you provide on a monthly basis on the calendar day corresponding to when your authorization is received. In some cases, your payment date may change without advance notice, for example if your Monthly Payment is not successfully received or if the corresponding day is not a business day.

Cancellation: You may cancel this Agreement at any time without penalty. To cancel this Agreement, contact Us at 800-248-6020 or support@cleanchoiceenergy.com. Please allow 3-5 business days for Us to process your cancellation.

Privacy of Consumer Information: You agree to the collection, use and disclosure of your personal information for the purpose of allowing Us to perform and enforce the Agreement, and for other purposes set out in CleanChoice Energy’s privacy policy, available at www.cleanchoiceenergy.com/privacy. 

Limitations of Liability and Warranty/Force Majeure: YOU AGREE THAT EVENTS OF FORCE MAJEURE MAY RESULT IN INTERRUPTIONS IN SERVICE AND THAT WE WILL NOT BE RESPONSIBLE SUPPLYING ELECTRICITY TO YOU AND WE WILL NOT BE LIABLE FOR THOSE INTERRUPTIONS. YOU AGREE THAT OUR LIABILITY NOT EXCUSED BY REASON OF FORCE MAJEURE OR OTHERWISE WILL BE LIMITED TO DIRECT ACTUAL DAMAGES ONLY; AND NEITHER OF US IS LIABLE TO THE OTHER FOR CONSEQUENTIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR INDIRECT DAMAGES. WE MAKE NO REPRESENTATIONS OR WARRANTIES AND WE EXPRESSLY DISCLAIM ALL OTHER WARRANTIES, WRITTEN OR ORAL, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE. "FORCE MAJEURE' MEANS AN UNAVOIDABLE OCCURRENCE BEYOND A PARTY'S CONTROL, LIKE EXTREME WEATHER EVENTS AND DOES NOT INCLUDE INABILITY TO PAY, AN INCREASE OR DECREASE IN TAXES OR, THE ECONOMIC HARDSHIPS OF A PARTY.

Additional Terms: This Agreement shall be governed by and construed according to the laws of Delaware. If any part of this Agreement is declared invalid for any reason, such determination shall not affect the validity of the remaining terms which shall remain in full force and effect.
