These Terms & Conditions, together with your signed written enrollment form, electronic online enrollment record, or recorded telephone voice enrollment is an agreement (“Agreement”) for purchase of carbon offsets between you (“Customer”) and CleanChoice Energy Solutions, LLC (“CleanChoice Energy,” “We,” or “Us”).

This is a one-time purchase of carbon offsets that helps replenish forests in the Mississippi River Valley. No refunds are available for this specific product.

Carbon Offsets: Carbon offsets fund projects that reduce the amount of carbon dioxide in our atmosphere. The carbon offsets we purchase are from the Green Trees Mississippi River Valley project, which is recognized as the leading carbon reforestation program in North America.

Payment and Billing: Your one-time payment for carbon offsets is the amount specified in the Price section above, based on the tons of CO2 selected to offset. We will process your one-time payment through the credit card or Automatic Clearing House (ACH) account you provide. 

Refunds: This is a one-time payment and refunds are currently not accepted. If you made an error in your purchase you may contact us at 800-248-6020 or support@cleanchoiceenergy.com to further assist you.

Privacy of Consumer Information: You agree to the collection, use and disclosure of your personal information for the purpose of allowing Us to perform and enforce the Agreement, and for other purposes set out in CleanChoice Energy’s privacy policy, available at www.cleanchoiceenergy.com/disclosures/privacy.

Limitations of Liability and Warranty/Force Majeure: YOU AGREE THAT EVENTS OF FORCE MAJEURE MAY RESULT IN INTERRUPTIONS IN SERVICE AND THAT WE WILL NOT BE RESPONSIBLE SUPPLYING ELECTRICITY TO YOU AND WE WILL NOT BE LIABLE FOR THOSE INTERRUPTIONS. YOU AGREE THAT OUR LIABILITY NOT EXCUSED BY REASON OF FORCE MAJEURE OR OTHERWISE WILL BE LIMITED TO DIRECT ACTUAL DAMAGES ONLY; AND NEITHER OF US IS LIABLE TO THE OTHER FOR CONSEQUENTIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR INDIRECT DAMAGES. WE MAKE NO REPRESENTATIONS OR WARRANTIES AND WE EXPRESSLY DISCLAIM ALL OTHER WARRANTIES, WRITTEN OR ORAL, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE. " force majeure means an unavoidable occurrence beyond a party control like extreme weather events and does not include inability to pay increase or decrease in taxes the economic hardships of party.

Additional Terms: This Agreement shall be governed by and construed according to the laws of Delaware. If any part of this Agreement is declared invalid for any reason, such determination shall not affect the validity of the remaining terms which shall remain in full force and effect.
